(1) By purchasing a ticket for one of the adventures (“Game(s)”), you (“Ticket Holder”) and any others in your party (“Guests”) agree to be bound by the Terms and Conditions of sale specified herein and any other provision as may be specified from time to time by Escape Room Mystery LLC (“Owner”). The Owner, their agents or employees shall not be liable for any death, personal injury, loss, damage however caused while in the venue, location or place related to Escape Room Mystery LLC (“Site”) nor are they liable for any complaints, claims, refunds, or exchange for any reason, including without limitation, cancellation, or postponement of the Game. Booking fees and any related fees or charges shall not be refundable. Any refunds shall be made only at Escape Room management’s discretion.? Tickets are sold subject to the following conditions:
(1a) You have expressly agreed to participate, join, enter, use, play and/or access to Escape Room Mystery LLC at your sole risk. You agree to refer any Guests to this website for Terms & Conditions & Privacy Notices therein.  To the fullest extent permissible by applicable law, Owner disclaims all warranties, express or implied, including but not limited to, implied warranties, merchantability or fitness for the operation of the Escape Room Games. Escape Room Owner / Venue Owner does not warrant the reliability, accuracy, completeness, current or error-free operation of the product, content and materials included, used, or deployed on the site. If a product, contents, or materials are not as described, you have expressly waived the right to claim any damages and/or losses including but not limited to direct, indirect, incidental, punitive, and consequential damages derived from such use or reliance of the description of the product, content,?or material.
(1b) All items including but not limited to your personal belongings, objects, luggage, baggage, watches, wallet, item and/or property, shall be brought to the Site by you at your sole risk. In any event, Owner including the employee or agent shall not be held liable or responsible for any loss of your personal belongings, objects, luggage, baggage, watches, wallet, item and/or property, either within the Site or outside of Site
(1c) To the fullest extent permissible by applicable law; Escape Room Owner / Venue Owner including the employee or agent shall not be responsible for any risk, hazard, danger, security, thread, safety and/or protection for the Game(s). You shall be solely responsible, answerable, accountable for your personal safety, security, body condition, disease transmission, pregnancy, health condition, while you participate, join, enter, use, play and/or access to Game(s). Owner hereby expressly warns, cautions, advises, informs, and/or notifies that the Game may be dangerous, hazardous, risky, and unsafe.  Nothing in these terms and conditions is intended to affect your statutory rights.
(1d) These terms and conditions and any contract concluded incorporating these terms and conditions shall be governed by United States law and all disputes shall be submitted to the exclusive jurisdiction of United States courts.
(1e) All the terms of any contract entered into are included or assigned to within these terms and conditions.

(2). The company holds the right to amend or vary these Terms and conditions including any of the contents of the website from time to time at its sole discretion without prior notice. The hereinafter terms apply to the use by any visitor of the Escape Room Mystery Website and should be read carefully before any use or purchase:
(2a)?Escape Room Mystery does its best to supply you with the most current and accurate information on its website.
(2b) The Escape Room Mystery website is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website.
(2c) You are not permitted to link to or use all or any part of the Escape Room Mystery’s website for any purpose which is fraudulent, unlawful, defamatory, harmful, obscene, or objectionable.
?(2d) You accept that the Internet is not fully secure. Escape Room Mystery will take all appropriate steps to protect the security of any payment card information though Escape Room Mystery shall not be liable for any damage that you may suffer as a result of the loss of confidentiality of any such information. Your payment is made on a third-party secure booking website.  The Owner does not internally save any credit card information.
(2e) Escape Room Mystery shall not be liable to any person for any direct or indirect, consequential, or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of any use of the website.

(3a) Children under the age of 16 must be accompanied at least by 1 adult known to them per game.
(3b) Only person(s) who are at least 18 years of age are permitted to book a Game.
(3c) Any concerns about accessibility or physical limitations of the Ticket Holder and their guests should be addressed with Owner or employees prior to purchase.

(4a) Once purchased, a confirmation of the Booking is issued to the Ticket Holder to the email provided at the time of booking.  It is the responsibility of the Ticket Holder to check for accuracy of the date, time and number of tickets purchased.
(4b) Ticket Holder is entirely responsible for entering personal details correctly on the online booking form.? By submitting an online booking form & completing the booking, you warrant to Escape Room Mystery that all details supplied for that transaction are true and accurate.  For bookings made by phone, it is the responsibility of the Ticket Holder to verify by reading of the confirmation booking email confirmation. Any errors should be reported to Owner within 24 hours of the purchase.
(4c) Bookings can be made online or walk-in on site at escaperoommystery.com/bookeo.html or via phone through an employee using the same site.  A walk-in purchase will be completed by Owner or employee.
(4d) Online bookings can only be made up to 3 months in advance.  Exceptions may be made by contacting Escape Room Mystery via email or phone.
(4e) Any major credit or debit card is accepted to settle the payment.
(4f) Full payment is required at the time of booking.
(4g) Your personal details are collected and stored by a third party booking system, Bookeo. Personal information and credit card information are not disclosed to any other party and is used solely for transactions between Ticket Holder and Owner.  Owner and Bookeo are dedicated to ensuring that the privacy of your personal information is protected. Your information is never sold to another party.
(4h) You will receive the confirmation of your booking via email only. Escape Room Mystery does not send confirmation via post or text message.

(4i) The price of Game(s) is stated on the Escape Room Mystery website and the Booking site.  Charges in the cart are final.  If there is a question about the charges, contact Escape Room Owner or agents with questions prior to the completion of the purchase, as all purchases are non-refundable.

(4j) The price is set per person, per private room, or per Exclusive Facility Rentals and published on the website.
(4k) All tickets are subject to a 10% amusement tax that Escape Room Owner and agents collect and remit to Upper Merion Township.  Due to the nature of the service provided and the tax, no person or entity is exempt from paying this tax.
(4l) Escape Room Mystery is a live event so once the booking is confirmed and payment made; refunds or are not issued. Escape Room Mystery will permit rescheduling of an entire booking with more than 3 days’ notice by either a ticket holder  with 10 or less tickets or one private room OR more than 14 days’ notice by ticket holders with more than 10 tickets or more than two private rooms or Exclusive Facility Rentals.  Partial rescheduling of a reservation is not permitted.
(4m) If less people attend the Game than were booked in a single transaction by the Ticket Holder, the price difference will not be reimbursed.
(4n) If a private room or the entire facility was booked as a flat fee, absences or fluctuations in the number of attendees will not result in partial refunds.
(4o) If you wish to transfer your Game(s) into someone else’s name, you must contact Escape Room Mystery by either email or telephone at least two hours before the start of the game. Escape Room Mystery reserves the right to refuse this transferal.
(4p) Tickets for Game(s) may not be transferred or resold for commercial purposes or at a premium. If a Game is transferred or resold in breach of this condition, the bearer of the Game or the person claiming the right to attend the event will be refused admission to the game.
(4q) No one is permitted to carry or bring any dangerous, harmful, or hazardous objects into the Site including but not limited to sharp object, explosive items, weapons, tools, or items deemed to be dangerous or harmful to other visitors on the Site. In the event if such item or object is found, Owner including the employee or agent shall have the power, authority and consent expressly granted by you to remove and confiscate such item or object and further decline or refuse your entry to the Site.

(5a) Owner asks Ticket Holders and Guests to arrive 15 minutes prior to their booking time. The 60- minute timer will start counting down at the time listed on the Game booked. Late arriving Ticket Holders and Guests are not guaranteed the full 60-minutes of game time.  Escape Room Owner and agents have the right to deny service without refund or compensation to ticket holders that arrive after their booking time.
(5b) To be admitted you must confirm the full name of the Ticket Holder and might be asked to confirm phone number and email address. Every participant must sign the safety form provided prior to entry to the game.  An adult over the age of 18 must sign for any children 17 and under.
(5c) To be fair to Guests who have arrived on time, we will not allow Ticket Holders or their Guests arriving more than 3 minutes late to enter their booked Game. They will be rescheduled for the next available time slot.  This may be on a future date.  No refunds will be given.
(5d) Ticket Holders and Guests will be instructed before their game by their assigned Guide. After learning the rules of the game, each player will participate in the Game at their own risk. Escape Room Mystery is not liable for any personal or equipment damages caused by Game room misuse or not following the rules described before the game.
(5e) Ticket Holders and Guests undertake to behave, conduct, perform, carry out, execute and complete the Escape Room Game in accordance with the instruction, command and rules specified by Owner; failing which Owner including the employee or agent shall have the right and power to refuse, decline or refuse your entry to the Site.
(5f) You shall not enter the Site under the influence of drugs or alcohol, failing which Owner or employee or agent shall reserve all rights and power to decline or refuse your entry to the Site. If you are found to be under such influence Owner or employee or agent shall have the power, authority and consent expressly granted by you to remove Ticket Holders and Guests from the premises without any compensation, remedy or damages and reserves all rights and authority to take the necessary legal action to ensure the reputation of Escape Room business remain intact and guard against any risk or harm towards the Escape Room business. All losses, damages or legal costs derived from such incident shall be solely borne by you.

(6a) Drinks and food may not be brought into the Game Rooms.
(6b) You shall not be allowed to record, capture, or snap any photograph, video, film, tape, audio recording whatsoever before, during and after the Game(s) save and except with the explicit permission of Owner. If such recording activity is found within the Site, Owner including the employee or agent shall reserve the power, authority and consent expressly granted by you to delete, remove, or transfer such recording to any device, media or hardware owned by Owner.  The copyright of such recordings will automatically be granted by you to Escape Room Owner.
(6c) Escape Room Mystery expects her visitors not to disclose any details of the game directly or indirectly to the public.
(6d) Owner is entitled to charge the guests for any damage, which is intentional, in violation of the rules or instructions given, or caused by misuse of items.
(6e) While you are at our premises, you must conform to our codes and regulations, adopt proper standards of behavior, and cooperate with Escape Room Mystery employees.
(6f) Escape Room Mystery doesn’t tolerate any kind of bullying or harassment towards its employees.
